LITIGATION EXPERIENCE

  • Representation of two homeowners in 2018 who were being sued by their former credit union in the amount of $1.8 million. We were successful in setting aside the enforcement of an unconscionable registered mortgage and raised defences based on the credit union’s unconscionable conduct, breaches of the Australian Consumer Law and the National Credit Code. The matter was ultimately resolved on the basis that each party walked away bearing their own legal costs, and no settlement sums were exchanged.
     

  • Representing the respondent in Federal Court proceedings commenced by our client’s former nationally recognised employer. The multi-million-dollar claim was for alleged breaches of our client’s employment agreement, enforcing our client’s restraint of trade and breaches of the Corporations Act 2001. We raised arguments that the restraint of trade clause in our client’s employment contract went further than protecting the legitimate business interests of the employer, and that they actually attempted to restrain our client from competition. Our client was ultimately successful, with the claim being dismissed and each party bearing their own legal costs.  
     

  • Advice for builders, contractors and individuals relating to industry standard construction and buildings contracts, as well as recovery options for unpaid work by way of subcontractor charges under the Building Industry Fairness (Security of Payment) Act 2017.
     

  • Representation of multiple lot owners who relied on misleading and deceptive marketing material provided by an international real estate agency in purchasing an off the plan unit in a Sunshine Coast development. 
     

  • Acting for deceased estates, one of which involved indefeasibility under the Land Title Act, Barnes and Addy claims, constructive trust and promissory estoppel claims and statutory time limitations. 
     

  • Acting for an international franchisor within the hospitality industry who has over 280 franchised stores Australia‑wide.  
     

  • Assisting in debt recovery matters in various Australian State jurisdictions for an international paint supplier and auto car parts and accessories retailer.

PROPERTY/COMMERCIAL EXPERIENCE

  • Acting for a high-net-worth individual who recently sold a large backpackers hotel and resort in Cairns for $56 million.
     

  • Acting for large property developers in residential and mixed commercial use off the plan projects and large multi staged flat land estates from site acquisition and due diligence through to registration and settlement.
